General Terms and Conditions

1. Scope of application

The following General Terms and Conditions (GTCs) shall apply to all orders placed on our online shop. Our online shop is directed exclusively to consumers.
A consumer is any natural person who concludes a legal transaction for purposes that cannot be predominately attributed either to their commercial business activities or their work as a self-employed person. An entrepreneur is a natural person or legal entity or a partnership that is carrying out its commercial business activities or work self-employed person when a legal transaction is concluded.

2 Contracting party & conclusion of contract

The representation of the products on the online shop do not represent a legally binding offer, but instead represent an unbinding online catalog. You can initially place our products in the shopping cart without commitment and correct your input at any time before you submit your binding order by using the correction tools, which are provided and explained during the ordering process. By clicking on the order button, you are submitting a binding order of the merchandise included in the shopping cart. A confirmation of receipt of your order is sent by email directly after your order is submitted.

The point in time when the contract comes into effect depends on the form of payment you select:

Credit card
We shall accept your order by sending a notice of acceptance in a separate email or by delivering the merchandise within two days.

PayPal
During the ordering process, you will be forwarded to the website of the online provider PayPal. You can enter your payment information there and confirm your payment instruction to PayPal. Once the order is placed in the shop, we will request PayPal to begin the payment transaction and will thereby accept your offer.

SOFORT online bank transfer
After submitting the order, you will be forwarded to the website of the online banking provider Sofort GmbH where you will confirm the payment instruction. The contract with us comes thereby into effect.

3. Contract language and record of contract text

The languages available for concluding the contract are German and English.

We do not save the text of the contract.

4 Delivery conditions

In addition to the product prices indicated, the following shipping costs shall apply. Here you can find out more details about shipping costs and shipping information.

We only deliver our merchandise through shipping. Unfortunately it is not possible to pick up your merchandise yourself.

We can also deliver to packing stations.

5. Payment

Generally, the following payment methods are available at our shop:

Credit card
While placing your order, you give us your credit card information.
Immediately after the contract is concluded and we verify you as the legally entitled cardholder, we will begin the payment transaction with your credit card company. The payment transaction will automatically be carried out by the credit card company and your card will be charged.

PayPal
During the ordering process, you will be forwarded to the website of the online provider PayPal. In order to be able to remit payment for the amount due using PayPal, you have to be registered there or you can first complete the registration process, prove your identity with your login details, and then confirm payment to us. Once the order is placed in the shop, we will request PayPal to begin the payment transaction.
The payment transaction is automatically carried out by PayPal directly afterwards. You will receive more instructions during the ordering process.

SOFORT online bank transfer
After submitting the order, you will be forwarded to the website of the online banking provider Sofort GmbH. In order to be able to pay the amount due using Sofort, you must have an online banking account with a PIN/TAN that has been activated for participation in Sofort bank transfers, you will have to prove your identity accordingly, and will have to confirm the payment order to us. You will receive more instructions during the ordering process. The payment transaction will automatically be carried out by Sofort GmbH and your account will be charged.

6. Reservation of proprietary rights

The goods shall remain our property until full payment is received.

7. Transport damage

If the merchandise is delivered with obvious transport damage, you should lodge a complaint with the delivery agent about these types of mistakes immediately if possible, and please contact us immediately. The failure to lodge a complaint or contact us does not have any consequences on your legal claims and enforcement, in particular on your warranty rights. However, you will assist us in being able to exercise our own rights against the freight forwarder and transport insurance company.

8. Cancellation policy

Consumers have a fourteen day right to cancel.

Right of cancellation

You have the right to cancel this contract within fourteen days without having to indicate the reasons.

The cancellation period is fourteen days from the day on which you or a third-party appointed by you, which is not the carrier, took possession of the final merchandise.

To exercise your right of cancellation, you must inform us,

by sending a clear statement (e.g., a letter sent by mail, fax, or email) about your decision to cancel this contract. You can use the sample cancellation form attached, which is not, however, required to be used.

To adhere to the cancellation period, it is sufficient if you send your notification about exercising your right of cancellation prior to the end of the cancellation period.

Consequences of cancellation

If you cancel this contract, we have to repay all payments we have received from you, including the delivery costs (with the exception of additional costs that stemmed from your having selected a different type of delivery than the least expensive standard delivery that we offer), immediately and at the latest within fourteen days from the day on which we received notification about your cancellation of this contract. For this repayment, we will use the same payment method that you used in your original transaction unless something else was explicitly agreed upon with you; under no circumstances will you be charged a fee due to this reimbursement. We can refuse to reimburse you until we have received the merchandise back or until you have submitted proof that you have sent the merchandise back depending on whichever is the earliest.

You must send back or consign the merchandise immediately, in any event at the latest within fourteen days from the day on which you informed us of the cancellation of this contract. The deadline is met if you send the merchandise before the end of the fourteen day period. We will be responsible for the costs of the return shipment. You only have to pay for any possible diminished value of the goods if this diminished value results from handling the goods in a manner other than what is necessary to ascertain the nature, features, and functioning of the goods.

The right of cancellation shall not exist in the following contracts:
Contracts for the delivery of sealed goods which are not suitable for return for reasons to do with public health or related to hygiene if their seal was removed after delivery.

10. Liability

We are always liable without limitation for any claims due to damages that were caused by us, our legal representatives, or agents;

  • for injury to life, limb or health;
  • for a willfully or grossly negligent breach of duty;
  • for guarantee promises, if they have been agreed to, or
  • if the purview of the Product Liability Act has been established.

If an infringement of essential contractual obligations, the fulfillment of which is a prerequisite for enabling the proper fulfillment of the contract in the first place and the observance of which the contracting partner may regularly expect (cardinal duties), occurs as a result of minor negligence by us, our legal representatives or vicarious agents, liability shall be limited to the amount equivalent to the damage that was foreseeable at the time when the contract was concluded and that typically occurs in such cases. Furthermore, any claims for compensation are excluded.

11. Dispute resolution

The European Commission provides a platform for online dispute resolution (OD), which you can find here https://ec.europa.eu/consumers/odr/.
We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
